The public prosecutor is responsible for the control and direction of all criminal prosecutions and proceedings. In Singapore, this role is played by the Attorney-General, who heads the Attorney-General’s Chambers (AGC).

  • “检察司”是英语“public prosecutor”的意译。在新加坡,也可指履行检察司职责的总检察长(Attorney-General)。
  • 检察司的主要任务是维护国家(人民)的权益,在刑事诉讼为主导者,在涉及国家或政府的民事诉讼时则代表国家或政府。根据宪法第35(8)条(Article 35(8) of the Constitution)规定,检察司有权针对任何罪行提起、进行或中止任何诉讼。
  • 新加坡总检察署于英国殖民地时期就已成立。自1867年开始,新加坡设立了检察司一职,汤姆斯布莱德尔(Thomas Braddell)被任命为第一任检察司。当时总检察署的职员都是外国人。

ETYMOLOGY
  • The Mandarin term “检查司” is a paraphrase of the English term “public prosecutor”. In Singapore, the term also refers to the Attorney-General when he or she acts in the capacity of the public prosecutor.
  • The public prosecutor’s main responsibilities are to protect the rights and interests of the country (and its people), lead criminal prosecutions, and represent the country or Government in civil litigations involving the country or Government. Under Article 35(8) of the Constitution, the Attorney-General in his role as Singapore’s public prosecutor has power to institute, conduct or discontinue any proceedings for any offence.
  • The Attorney-General’s Chambers (AGC) was established in 1867, with Sir Thomas Braddell as the first public prosecutor.
  • Following Braddell, there were a total of 15 British public prosecutors.
  • It was only in 1959 that the first local public prosecutor, Dr Ahmad bin Mohamed Ibrahim, was appointed.
  • The Crime Division of the AGC is responsible for all criminal prosecutions, and its officers may be appointed by the public prosecutor to act as Deputy Public Prosecutors (DPPs) or Assistant Public Prosecutors (APPs).
