由来

英语 “mandatory imprisonment” 的意译。
按照新加坡刑事法典（Penal Code），若被告犯下特定罪行并被判罪名成立，法官需判处相同或大于该罪行规定的最低监禁期限的刑罚。
在新加坡刑法中，设置强制性监禁是为了达到两个目标：一、对社会的威慑性作用；二、防止罪犯对社会造成更多危害的预防性作用。

ETYMOLOGY

The Mandarin term “强制性监禁” is a paraphrase of the English term “mandatory imprisonment”.
According to Singapore Penal Code, if the accused is found guilty of committing a crime, the judge must impose a sentence equal to or greater than the minimum term of imprisonment for the crime committed.
Under the Penal Code, mandatory imprisonment serves to achieve two goals: first, the deterrence on the society at large; second, the prevention of the criminal’s ability to cause more harm to society.

例句

根据 1998 年通讯及多媒体法令，最高刑罚是罚款不超过 5 万令吉或监禁不超过一年或两者兼施；至于在 1972 年官方机密法令下，罪成者可被强制性监禁 1 至 7 年。（《联合早报》，27/4/ 2017）

SAMPLE SENTENCE

According to the Communications and Multimedia Act 1998, the maximum penalty is a fine of not more than 50,000 Malaysian Ringgit or imprisonment not exceeding one year, or both. As for the Official Secrets Act 1972, convicted offenders could be sentenced to mandatory imprisonment of one to seven years. (Lianhe Zaobao, 27/4/2017)
